Terms of Service

1. Acceptance of terms
By creating an account or using FranjoPos, you agree to be bound by these Terms of Service. If you do not agree, you may not use the service. These terms apply to all users including restaurant owners, staff, and administrators.
2. Service description
FranjoPos provides cloud-based point-of-sale, table management, kitchen display, inventory, and backoffice software for food & beverage businesses ("the Service"). The Service is provided on a subscription basis.
3. Account registration
You must provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorised use.
4. Subscription and billing
Subscription fees are charged monthly or annually in advance. All prices are in EUR and exclude applicable VAT. We reserve the right to change pricing with 30 days written notice. No refunds are provided for partial subscription periods.
5. Free trial
New accounts receive a 14-day free trial with full access to all features. No credit card is required during the trial. After the trial, you must subscribe to continue using the Service.
6. Data ownership
You retain full ownership of all data you enter into FranjoPos, including orders, products, customer data, and operational data. We claim no intellectual property rights over your data.
7. Acceptable use
You may not use FranjoPos for unlawful purposes, to transmit harmful or fraudulent data, to violate the rights of third parties, or to interfere with the operation of the Service. We reserve the right to suspend accounts that violate these terms.
8. Service availability
We target 99.9% monthly uptime and publish our status at status.franjopos.com. Scheduled maintenance is announced 48 hours in advance. We are not liable for downtime caused by circumstances outside our reasonable control.
9. Limitation of liability
To the maximum extent permitted by law, FranjoPos shall not be liable for indirect, incidental, or consequential damages arising from use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
10. Termination
You may cancel your account at any time from the Settings page. We may terminate your account for material breach of these terms. Upon termination, your data is retained for 90 days and then permanently deleted.
11. Governing law
These terms are governed by the laws of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany.
